01Parties & acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between Onehostplanet s.r.o., a limited liability company incorporated in the Czech Republic ("the Company", "we", "us"), and you, the individual or entity ordering services ("Customer", "you").
By signing up for an account, placing an order, or using any service provided by hostfory, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the services.
02Services provided
The Company provides the following infrastructure services under the hostfory brand:
- Dedicated bare-metal servers with 1 / 10 / 100 / 400 Gbit/s ports
- Cloud and 100G VPS instances
- GPU servers based on NVIDIA RTX PRO Blackwell platforms
- High-density storage servers (ZFS, ECC, NVMe-cached)
- IP transit, BGP peering, anycast, DDoS protection
- Looking-glass tools, route servers, RPKI validators

03Account & registration
To use the services you must create an account at my.hostfory.com and provide accurate, complete and current information. You are responsible for:
- Maintaining the confidentiality of your credentials and API keys.
- All activity that occurs under your account, whether authorized or not.
- Promptly notifying us of any unauthorized access or suspected breach.
We may verify your identity (KYC) where required by law or where high-risk indicators are present. We reserve the right to refuse or terminate accounts at our sole discretion, including for previous abuse, fraud or sanctioned-jurisdiction customers.
04Fees & billing
4.1 Pricing
Service fees are quoted in EUR or USD as displayed at the time of order. Prices are exclusive of applicable VAT, which is added at the rate required by your jurisdiction.
4.2 Setup & recurring fees
Setup fees, where applicable, are charged once at provisioning. Recurring fees are charged in advance for the next billing period (monthly, quarterly or annually).
4.3 Payment methods
We accept payment by SEPA bank transfer, credit and debit cards (via Stripe), PayPal, and major cryptocurrencies. The customer is responsible for any payment-processor fees, currency-conversion costs and bank charges.
4.4 Late payment
Invoices are due within 7 calendar days of issuance unless otherwise agreed in writing. After 7 days of non-payment, services may be suspended. After 30 days, services are subject to permanent termination and data deletion.
4.5 Refunds
Setup fees and prorated usage are non-refundable. Customers may cancel pre-paid services and receive a refund for unused full months at the Company's discretion, subject to deduction of setup, license and bandwidth-overage costs.
05Renewal & cancellation
Services renew automatically at the end of each billing period at the then-current price unless cancelled. To cancel, submit a cancellation request through the customer panel at least 3 days before the renewal date. Cancellations within 3 days of renewal take effect at the end of the next billing period.
06Service-level agreement
We commit to the following SLA targets, measured monthly:
SLA credits, where applicable, are issued on request as a percentage of the monthly fee for the affected service. Maximum credit per month is 100% of that month's fee. SLA credits are the sole and exclusive remedy for service unavailability.
07Customer data & backups
You retain full ownership of all data you store, transmit or process on our infrastructure. We act solely as a data processor where required by GDPR.
You are solely responsible for backing up your data. Unless you have purchased a managed backup service from us, we do not maintain backups of customer servers, VMs or storage volumes. We strongly recommend off-site, encrypted backups.
08Suspension & termination
We may suspend or terminate any service, with or without notice, in any of the following circumstances:
- Non-payment of invoices.
- Violation of our Acceptable Use Policy.
- Activity that endangers our network, infrastructure or other customers.
- Use of the services for illegal activity under Czech, EU or applicable international law.
- Receipt of a valid law-enforcement order requiring suspension.
- Fraudulent payment or misrepresentation during registration.
On termination for cause, fees paid are non-refundable, and customer data may be deleted at any time after termination. We will give reasonable notice before deletion where circumstances permit.
09Limitation of liability
To the maximum extent permitted by Czech law, the Company's total liability for any claim arising from or related to the services is limited to the fees paid by the Customer for the affected service in the three (3) months immediately preceding the event giving rise to the claim.
We are not liable for:
- Loss of data, profits, revenue, or business opportunities.
- Indirect, incidental, consequential or punitive damages.
- Damage caused by the customer's actions, third-party services, or events of force majeure.
- Interruptions caused by upstream transit providers, IXPs, or peers despite reasonable network design.
10Indemnification
You agree to indemnify and hold harmless Onehostplanet s.r.o., its directors, employees and partners from any claim, damage, fine, or legal cost arising from:
- Your use of the services.
- Content hosted, transmitted or processed on your servers.
- Your violation of these Terms, our AUP, or any applicable law.
- Infringement of third-party intellectual-property or privacy rights.
11Warranties
Services are provided "as is" and "as available". Beyond the SLA expressly stated in Section 6, we make no warranties — express, implied or statutory — including merchantability, fitness for a particular purpose, or non-infringement.
12Force majeure
Neither party is liable for any failure or delay in performance caused by events beyond reasonable control, including natural disasters, war, terrorism, civil unrest, governmental action, large-scale internet outages, fiber cuts on multiple upstream carriers simultaneously, sustained nation-state level cyber-attacks, or pandemic-related restrictions.
13Governing law
These Terms are governed by the laws of the Czech Republic, excluding its conflict-of-laws provisions and the UN Convention on Contracts for the International Sale of Goods. The competent courts of Prague have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law provides otherwise.
